Last Updated: 9 October 2026
1. Welcome to M8KE
Welcome to M8KE.
We specialise in promotional products, corporate apparel, workwear, teamwear and customised branding solutions for businesses and organisations across Australia.
These Terms & Conditions explain the conditions associated with using our website and engaging M8KE for quotations, product sourcing, branding and supply.
By accessing our website, you agree to comply with the website-related terms below.
Where you place an order with M8KE, the applicable order terms, quotation and any separately agreed conditions will govern that transaction.
Nothing in these Terms & Conditions excludes rights or remedies that cannot lawfully be excluded under Australian law.
2. Website Information
Our website is designed primarily for product browsing, product information, branding previews and quotation enquiries.
Products displayed on our website are not necessarily available for immediate purchase.
Product images, descriptions, colours, dimensions and specifications are provided as a general guide and may change without notice.
We make reasonable efforts to maintain accurate information but recommend confirming product specifications, availability and pricing before placing an order.
3. Product Enquiries and Quotations
Customers may request quotations through our website, email or directly with our team.
Unless otherwise stated:
- Quotations for stocked products are valid for 14 days.
- Quotations for offshore or custom-manufactured products are valid for 7 days.
- Pricing is subject to stock availability, final specifications and applicable freight charges.
- All prices are quoted in Australian dollars.
- GST will be identified in the quotation where applicable.
A quotation does not guarantee stock availability or production capacity until an order is accepted and confirmed.
4. Orders and Acceptance
Orders are subject to confirmation by M8KE.
An order is generally accepted when M8KE confirms the order in writing, including the agreed products, quantities, pricing and relevant specifications.
Production may also depend on artwork approval, payment of any required deposit and availability of materials.
Any requested changes after order confirmation may affect pricing and delivery schedules.
5. Artwork and Branding Approval
Customers are responsible for reviewing and approving artwork before production.
Artwork approval may include:
- Logo placement and sizing.
- Colours and branding specifications.
- Spelling, wording and layout.
- Product styles, sizes and quantities.
- Decoration methods and production details.
Once written approval is received, M8KE may proceed with production.
Changes requested after production has commenced may result in additional costs or revised delivery dates.
We encourage customers to carefully review all artwork before approval.
6. Customer-Supplied Logos and Artwork
Customers uploading or supplying logos, artwork, trademarks or other materials confirm that they own the relevant rights or have permission to use those materials for the requested purpose.
M8KE may use customer-supplied artwork to prepare quotations, visual presentations, samples and approved products.
We will not knowingly reproduce artwork that infringes another party's intellectual property rights.
Where reasonable grounds exist to believe artwork may be unauthorised or inappropriate, M8KE may request further information or decline to reproduce it.
7. 3D Product Previews and Digital Mock-ups
Our website may provide tools allowing customers to upload artwork and preview branding on selected products.
These previews are intended as visual guides only.
Actual production results may vary due to product materials, decoration methods, printing limitations, lighting and screen settings.
A digital preview does not constitute final production approval.
M8KE will provide appropriate artwork confirmation before production where required.
8. Product Colours and Manufacturing Variations
We make reasonable efforts to reproduce colours and branding accurately.
However, minor variations may occur due to:
- Different materials and fabric compositions.
- Printing, embroidery and decoration processes.
- Screen and monitor colour differences.
- Manufacturing tolerances.
- Supplier production batches.
Where Pantone or PMS colours are specified, we will endeavour to achieve the closest practical match using the selected production method.
Exact colour reproduction cannot always be guaranteed.
Where precise colour matching is essential, customers should discuss sampling or colour approval requirements before production.
9. Product Availability and Substitutions
Product availability may change due to supplier stock levels, manufacturing capacity or other circumstances.
If a selected product becomes unavailable, we will discuss suitable alternatives with the customer.
We will seek customer approval before proceeding with a material change to an agreed product or specification.
10. Order Quantities
Certain custom-manufactured products may be subject to manufacturing quantity tolerances.
Where applicable, an over-supply or under-supply allowance of up to 5% may be specified in the quotation and agreed before production.
Any permitted quantity variation and corresponding price adjustment will be handled according to the agreed quotation or order conditions.
11. Payment Terms
Payment requirements will be outlined in the relevant quotation or invoice.
For larger or custom-manufactured orders, M8KE may require a 50% deposit before production commences.
The remaining balance will be payable in accordance with the agreed payment terms.
Approved business customers may be offered credit account arrangements, subject to separate approval.
M8KE may delay commencement of production or delivery where payment conditions have not been satisfied, subject to applicable law and agreed contractual obligations.
12. Production and Delivery
Production and delivery timeframes will be discussed during the quotation and order confirmation process.
Unless expressly agreed otherwise, estimated delivery dates are indicative and may be affected by manufacturing, supplier availability, freight or other circumstances.
We will make reasonable efforts to meet agreed deadlines and communicate significant delays as soon as practicable.
Customers should advise M8KE of any critical event dates or delivery requirements before approving an order.
13. Freight and Delivery Charges
Freight charges are excluded from quotations unless expressly stated otherwise.
Delivery costs will be confirmed where applicable.
Customers are responsible for providing accurate delivery details and any relevant site access instructions.
Additional costs arising from incorrect delivery information or customer-requested changes may be charged where reasonable and agreed.
14. Changes and Cancellations
We understand that project requirements sometimes change.
Customers should contact M8KE as soon as possible if they wish to amend or cancel an order.
Where production has not commenced, we will endeavour to accommodate reasonable changes.
Once materials have been purchased, products customised or manufacturing commenced, cancellation or amendment may involve costs already reasonably incurred.
Any applicable charges will be assessed according to the stage of production, the agreed order terms and Australian law.
15. Returns, Faults and Product Concerns
M8KE is committed to supplying products that meet agreed specifications and reasonable quality expectations.
Because many products are customised or branded specifically for customers, change-of-mind returns may not be available.
However, this does not affect any rights or remedies available under Australian Consumer Law.
If an item is faulty, damaged or does not meet the agreed specifications, customers should contact us promptly with relevant details and photographs where available.
We will assess the concern and work towards an appropriate resolution, which may include repair, replacement, refund or another remedy as required by law.
16. Samples
Samples may be provided where available to assist customers with product selection, material assessment or branding decisions.
Sample charges, freight costs and any applicable conditions will be confirmed before dispatch.
Where a pre-production sample is required, the associated costs and approval process will be outlined in the quotation.
17. Intellectual Property
Unless otherwise agreed, the M8KE name, branding, website content, graphics and original materials created by M8KE remain the intellectual property of M8KE or their respective owners.
Customers retain ownership of their own logos, trademarks and supplied artwork.
Website content may not be reproduced or commercially used without appropriate permission.
18. Third-Party Websites and Services
Our website may contain links to external websites, supplier catalogues or third-party technology services.
These services may operate under their own terms and privacy policies.
M8KE is not responsible for the independent content or practices of third-party websites outside our control.
19. Website Availability and Security
We take reasonable steps to maintain a reliable and secure website.
However, we cannot guarantee uninterrupted access or that the website will always be free from technical issues.
Customers should avoid uploading malicious files, attempting unauthorised access or using the website in a manner that interferes with its operation.
We may restrict access where reasonably necessary to protect our website, systems or other users.
20. Limitation of Liability
To the extent permitted by Australian law, M8KE is not responsible for losses arising solely from temporary website interruptions, inaccurate customer-supplied information or unauthorised use of the website.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded.
Where liability may lawfully be limited, any limitation will operate only to the extent permitted by applicable law.
21. Australian Consumer Law
Our products and services come with guarantees that cannot be excluded under Australian Consumer Law where those guarantees apply.
Customers may be entitled to remedies where goods or services fail to meet applicable consumer guarantees.
These Terms & Conditions should be read alongside those statutory rights.
22. Changes to These Terms
M8KE may update these Terms & Conditions from time to time.
Updated terms will be published on our website.
Changes will not retrospectively alter existing confirmed orders unless agreed by the parties or otherwise permitted by law.
23. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia, subject to any mandatory laws that apply.
